General Terms and Conditions (GTC) for the 39 Boards Online Shop
In case of discrepancies between the German and English version, the German version shall prevail.
1. Scope
These Terms and Conditions apply to all orders placed by consumers via the website of 39 Boards, Vincent Ramon Thieme, Hauptstraße 52a, 10317 Berlin, Germany (hereinafter referred to as the “Seller”).
A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities as defined in Section 13 of the German Civil Code.

The presentation of products on the website does not constitute a legally binding offer but rather an invitation to place an order.
By clicking the PayPal payment link and completing the payment, the customer submits a binding offer to conclude a purchase contract.
The contract is concluded when the seller accepts the order by sending an order confirmation via email or by dispatching the goods.
3. Prices and Shipping Costs
All prices stated on the website are final prices.
In accordance with Section 19 of the German Value Added Tax Act (small business regulation), VAT is not shown separately.
Shipping costs may apply in addition to the stated prices. The applicable shipping costs are displayed on the website.
4. Payment Terms
Payment is processed via the payment service provider **PayPal.
Customers may also pay via credit card or other payment methods offered by PayPal without having their own PayPal account.
The purchase price is due immediately upon completion of the order.
5. Delivery
Delivery is made to the address provided by the customer.
Shipping is usually carried out via the shipping service provider **DHL or a comparable shipping provider.
Delivery time is generally 8 to 15 business days after receipt of payment, unless otherwise stated in the product description.
The seller currently delivers primarily within Germany but reserves the right to offer delivery within the European Union.
6. Transfer of Risk During Shipping
If the customer is a consumer, the seller bears the risk of accidental loss or accidental deterioration of the goods until the goods are handed over to the customer.
7. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal.

8. Voluntary Exchange and Return Policy
In addition to the statutory right of withdrawal, the seller offers a voluntary 30-day exchange or return policy.

In the case of justified complaints (e.g. incorrect delivery or manufacturing defects), the seller will bear the return shipping costs.

9. Warranty
The statutory warranty rights apply.
No warranty is provided for damage caused by improper use, external influences, or normal wear and tear.
10. Liability
The seller shall be liable without limitation for damages resulting from injury to life, body, or health.
For other damages, the seller shall only be liable in cases of intent or gross negligence.
In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for the contract.
Liability under the German Product Liability Act remains unaffected.
11. Availability of Goods
If an ordered product becomes permanently unavailable for reasons beyond the seller’s control, the customer will be informed immediately.
Any payments already made will be refunded without delay.
12. Contract Language and Storage of Contract Text
The contract language is German.
The seller stores the contract text. After completing the order, the customer will receive an order confirmation by email containing the contract details.
13. Dispute Resolution
The seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Data Protection
The privacy policy of the online shop applies and can be viewed on the website.
15. Final Provisions
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
Should any provision of these Terms and Conditions be invalid or become invalid, the validity of the remaining provisions shall remain unaffected.
